Public Description:
S. 1351, the H-1B Visa Program Modernization Act, would authorize the Department of Labor (DOL) to review employers' H-1B petitions for "clear indicators of fraud or misrepresentation of material fact" instead of the current standard of only reviewing for "completeness and obvious inaccuracies"; would prohibit employers from advertising a job as available only for H-1Bs or from recruiting only H-1Bs for a job; would prohibit employers from hiring H-1Bs if they employ more than 50 people and more than 50 percent of their employees are H-1Bs; would grant DOL more authority to investigate employers; would require DHS to share with DOL any information in H-1B petitions that indicates an employer is not complying with H-1B program requirements; and would require that H-1Bs be informed by the Federal government about their rights pursuant to this bill.
