Public Description:
The bill would require each state and their local law enforcement agencies to collect and report all immigration and DWI-related information as a prerequisite for receiving State Criminal Alien Assistance Program (SCAAP, a program that provides assistance to states for the incarceration of illegal aliens) funding. DWI-related information would then appear as a flag on the wants/warrants page of the National Crime Information Center (NCIC) database. This legislation would also require DHS to reimburse costs associated with training state and local law enforcement employees on how to work with federal immigration laws [287(g)] and would authorize these agencies to apprehend and detain an alien for a DWI or a similar violation.
To amend the Immigration and Nationality Act with respect to detention of unlawfully present aliens who are apprehended for driving while intoxicated, to improve State and local enforcement of immigration laws, and for other purposes.
