Fed Judge Blocks Gov. Abbott's Order Barring Private Transport of Illegal Aliens

On Wednesday, a Federal Judge in Texas sided with the Biden Administration in blocking an executive order issued by Gov. Greg Abbott that limited private organizations from transporting illegal aliens into the country.

The order from Gov. Abbott, issued in July, made it illegal to transport illegal aliens in an automobile unless done by official state entities; Texas officials argued it was intended to stem the resurging spread of Covid-19.

Federal District Court Judge Kathleen Cardone, a George W. Bush appointee, sided with Biden's Department of Justice, stating:

Because Governor Abbott's Executive Order authorizes Texas Department of Public Safety officers to make and act upon immigration determinations, the province of federal law, it violates the Supremacy Clause of the United States Constitution.

Abbott's order also directed the Texas DPS to "stop any vehicle upon suspicion" of transporting illegal aliens and said the agency would be authorized to "impound a vehicle" that was used to transport a group of aliens. The ruling nullifies the order.

In the DOJ suit, the federal government argued:

"As part of the execution of U.S. immigration laws, there are a variety of circumstances in which noncitizens must be transported between locations," noting that illegal aliens "need transportation, frequently through privately arranged travel by bus or rail."
