Today the U.S. Supreme Court refused to consider the Trump Administration's appeal of a federal district judge ruling that requires the government to continue to process Deferred Action for Childhood Arrivals (DACA) renewals. The court said, "It is assumed the court of appeals will act expeditiously to decide this case."
Judge William Alsup on January 9th ruled the Administration must continue accepting DACA renewals. The Justice Department appealed his ruling to the Ninth Circuit Court of Appeals and the Supreme Court simultaneously, saying, "The district court has entered an unprecedented nationwide injunction requiring the government not simply to tolerate, but to affirmatively sanction, a continuing violation of federal law by nearly 700,000 aliens."
The dual track is unusual. The Supreme Court has taken few cases that bypass the federal appeals courts. With today’s decision, the Administration must pursue the case in the Ninth Circuit, which has just begun work. The Justice Department said this could delay the case’s return to the Supreme Court for a year.
