The Supreme Court has denied the Obama administration’s petition to rehear the DAPA case after a new Supreme Court justice is confirmed. This decision upholds the lower court’s injunction against Pres. Obama’s DAPA and extended DACA amnesties.
“The Obama administration’s unprecedented attempt to rewrite federal immigration law failed yet again today,” said Carrie Severino, chief counsel at the Judicial Crisis Network. “It’s fitting that the Texas immigration case, which typifies this administration’s relentless overreach, met its end in a wordless denial by the Supreme Court.”
The 4-4 Supreme Court tie upheld the lower’s court decision but did not set a national precedent which could make it easier for the court to rule on the matter in the future.
One illegal alien, who would have been eligible for Pres. Obama’s DAPA amnesty, has filed a law suit in New York saying that the lower court does not have nationwide jurisdiction.
