Tuesday, U.S. District Judge Emmet Sullivan issued an order barring federal authorities from continuing to expel migrants under the public health order Title 42. Sullivan said the health policy was "arbitrary and capricious" and violated the Administrative Procedure Act.
Title 42 was initially enacted by President Trump at the onset of the coronavirus pandemic in March 2020. According to Customs and Border Protection data, the Trump Admin. used the authority to expel more than 185,000 migrants in fiscal year 2020, while the Biden admin. removed 937,000 in 2021 and 983,000 in 2022.
In April, the CDC announced that it would end the pandemic border order at the end of May 2022; however, a Louisiana federal judge halted that action in response to a lawsuit levied by two dozen Republican-led states.
Judge Sullivan accepted an unopposed stay motion filed by the Biden Admin. asking for five weeks to prepare for the order to end.
"'The delay in implementation of the court's order will allow the government to prepare for an orderly transition to new policies at the border,' the Department of Homeland Security said in a statement," reports Fox News.
This news comes as record numbers of illegal aliens pour across the southern border, with an astounding ~2.4 million encounters in fiscal year 2022. Supporters of the health order argue that ending Title 42 could exacerbate the continuing border crisis.
