USCIS: Disney and Other Companies Under Investigation for H-1B Abuse

Acting USCIS Director James McCament responded to a letter by Sen. Chuck Grassley (R-Iowa) stating that the agency has multiple investigations, “regarding the possible misuse of the H-1B program” by employers such as Disney, Northeast Utilities (Eversource Energy), and the University of California San Francisco. All three of these companies were highlighted in the 60 Minutes investigation on how American workers are being replaced by foreign H-1B workers.

McCament also confirmed that the agency is reviewing previously filed visa petitions and are conducting unannounced site visits to these and other H-1B employers. They have also created an email address where anyone (including American workers and H-1B visa holders) can contact the agency with tips, allegations or other relevant information about potential H-1B abuse. If any violations of the program are found they will refer their findings to ICE he said.

The letter also responded to Sen. Grassley’s question about Pres. Trump’s ‘Buy American, Hire American’ executive order, which ordered the agency to review the H-1B visa program. The acting director wrote that, “Pursuant to the Buy American, Hire American Executive Order, the Department will be providing recommendations to enhance the program’s integrity and to better protect U.S. workers who may be disadvantaged by the program."
