While that may seem counterintuitive to Americans accustomed to bleaker images of Africa, recent studies have documented the flight of immigrant professionals from the United States to their home countries. Chinese and Indian workers increasingly say they see better opportunities and lifestyles at home.

The immigration system, broken in a thousand places, needs a multitude of fixes, from the borders to the workplace to the status of would-be Americans waiting in limbo overseas and toiling in shadows here. A new bill called AgJobs, introduced in the House and Senate, addresses some of those problems. It seeks to relieve chronic farm labor shortages while protecting rights and opportunities for immigrant workers.

In Burlington and Middlebury, police have policies in place not to bother Hispanics about immigration issues unless they're breaking the law.

Far away from these debates lies one quiet corner of U.S. immigration policy: the program for what are known as "genius" visas. These visas are awarded to immigrants with extraordinary abilities in the arts, sciences, education, business, or athletics. The program, for what are officially called O-1 visas, began in 1990 as lawmakers sought to separate these applicants from the pool of those seeking H-1B visas, the visa program for skilled immigrants used by many technology companies.

Bergman cited an October raid of an N.C.-based House of Raeford Farms plant in Greenville, S.C. More than 300 workers were detained. The plant manager, the human resource manager and about a dozen supervisors were arrested on immigration charges.“When you actually hear that they're going to go ahead and prosecute, take to court the people who actually did the hiring, that's a big concern for HR people,” he said.
